PUBLIC OFFER AGREEMENT

- GENERAL PROVISIONS

- RIGHTS AND OBLIGATIONS OF THE PARTIES
3.1. The customer has the right:

3.2. The Contractor has the right:

3.2.2. 3.2.7. In exceptional cases, replace previously confirmed numbers with numbers of the same or a higher category at no extra charge.
3.2.9. In the case of group bookings for more than 4 people, and in accordance with article 3.3.13 of this Offer, the Contractor has the right to demand an irrevocable prepayment of 30 % of the total cost of the order.
3.3. The customer must:

3.3.2. Agree to the terms of this Offer.
3.3.4. Indicate the current contact information during registration and placing an order (full name, phone number, e – mail ).

3.3.6. Pay in full the completed order and / or Service at the time of check-in, or at the time of placing the order (in accordance with article 781 of the Civil Code of the Russian Federation).
3.3.7. In case of payment by credit card via the Internet, use only a credit card owned by the Customer. 3.3.8. 4.5. - ORDER OF PROVISION OF SERVICES AND RESPONSIBILITY OF PARTIES
5.1. The order of residence at Safari Hostel Moscow is established by the Contractor.

5.5. Documents required for settlement:

– a visa valid on the territory of the Russian Federation .
5.6. Reasons for refusing to provide Services and accommodation at Safari Hostel Moscow :
5.6.1. Failure to provide in full the documents listed in clause 5.5. of this Offer; 5.6.2. Failure to comply with applicable laws of the Russian Federation;
5.6.3. Non-compliance by the Customer with any of the paragraphs of the Rules of residence at Safari Hostel Moscow .
5.7. The Contractor has the right to refuse to provide the Services to the Customer without explanation. In this case, an advance payment for unproven Services is returned to the Customer. Refunds will be made to the Customer’s bank account from which the payment was made, within 14 (fourteen) business days from the date of refusal to provide accommodation.
5.8 . The Contractor has the right to evict the Customer from Safari Hostel Moscow in case of violation of the Legislation of the Russian Federation, the Rules for living at Safari Hostel Moscow , the conditions of this Offer or the receipt of reasonable complaints by other Customers , as well as impose penalties on this Customer in accordance with clause 5.9 of this Offer Agreement . A RESPONSIBILITY. DISPUTE RESOLUTION
6.1. The Customer represents the interests of all the persons indicated in the order and is personally responsible to the Contractor for the correctness of the data provided in the application about them, for the fulfillment by all persons of all obligations, including obligations to pay for the order and pay a fine in case of refusal to provide the Services (including not check in).
6.2. The Contractor shall not be liable in case of non-performance or improper performance of the Services on its part or on the part of third parties arising from the inaccuracy, insufficiency or untimelyness of the confirming information and documents provided by the Customer, as well as arising from other violations of the terms of this Offer by the Customer.
6.3. The Contractor is not responsible for the failure to provide the Services to the Customer in the event the Customer does not arrive on the first day of the reserved period of residence and, as a result, its subsequent impossibility to check in.
6.4. The Contractor is not responsible for the discrepancy of the services provided and the Services provided with the expectations of the Customer and his subjective assessment.
6.5. The parties will make every effort to reach agreement on controversial issues through negotiations. If it is not possible to reach an agreement in the negotiations, the disputes arising are subject to consideration in the court of g . Moscow at the place of registration of the Contractor.
6.6. For all other issues not provided for in this Offer, the Parties are guided by the current legislation of the Russian Federation. All possible disputes arising from the provisions of the Offer will be resolved in the courts of the Russian Federation in accordance with the current legislation of the Russian Federation.
6.7. The customer is liable for the intentional damage to property of Safari Hostel Moscow in accordance with the current Administrative and Criminal legislation of the Russian Federation.
6.8. In case of malicious or repeated non-compliance by the Customer with the provisions of this Agreement and the Rules of residence at Safari Hostel Moscow , as well as the legislation of the Russian Federation, the Customer can be evicted from Safari Hostel Moscow , regardless of the time of year or day, without compensation for prepaid accommodation.
7.1. In case of force majeure circumstances that the Party under this Agreement could neither foresee nor prevent by reasonable measures, the deadline for fulfilling obligations under this Agreement shall be postponed in proportion to the time during which such circumstances continue to operate, without compensation for any losses.
7.1.1 For such extraordinary events, in particular: flood, fire, earthquake, explosion, storm, land subsidence, and other natural phenomena, epidemics and war or military operations, actions and decisions of public authorities, disruptions arising in telecommunication and energy networks, power surges, the effects of malware, as well as unscrupulous actions of third parties, expressed in actions aimed at unauthorized access and / or disabling software and / or hardware complex of each of the Parties. 7.2. The party for which a situation has arisen in which it has become impossible to fulfill its obligations due to the occurrence of force majeure circumstances is obligated to notify in writing immediately (but no later than 5 (five) business days) of the occurrence, estimated duration and termination of these circumstances in writing the other side.
7.3. In the event of a dispute about the time of occurrence, the period of validity and the end of force majeure circumstances, the conclusion of the competent authority at the location of the Party concerned will be an appropriate and sufficient confirmation of the beginning, duration and end of the circumstances.
7.4. Failure to notify or untimely notification of a party about the beginning of force majeure circumstances deprives her of the right to refer to them as a basis exempting from liability for failure to fulfill obligations under this agreement.
7.5. If force majeure circumstances and / or their consequences continue to be valid for more than 30 (thirty) consecutive calendar days, the Agreement may be terminated at the initiative of either party by sending a written notice to the other party.
- AMENDMENT AND TERMINATION OF THE AGREEMENT
8.1. This Agreement shall enter into force upon the start of the process of placing an order or booking by the Customer and is valid indefinitely.
8.2. The customer has the right to refuse the Services of the Contractor at any time. The refusal of the Customer entails the termination of all obligations of the Contractor before him from the moment of such refusal.
8.3. The customer has the right to terminate the Agreement in accordance with section 4 of this Agreement. 8.4. The Contractor has the right to amend the terms of this Agreement and its Applications, introduce new Annexes to this Agreement without prior notice. The customer, knowing the possibility of such changes, agrees that they will be made. If the Customer continues to use the services of the Contractor after such changes, this means his agreement with them.
- DATA CONFIDENTIALITY
9.1. The Contractor guarantees the Customer the confidentiality of the data provided by him for the purpose of booking the Services.
9.1.1. The Customer (personal data subject), by fulfilling the provisions of this Offer, gives his unconditional consent to the provision of his personal data to the Contractor and gives his unconditional consent to their processing freely, by his own will and in his interest, including those made using automation tools or without the use of such funds, including the collection, recording, accumulation, storage, clarification (update, modification), extraction, use, transfer (spreading , provided e, access), depersonalization, blocking, deletion, destruction of personal data, entering them into the Contractor’s database with the possibility of using for information purposes, as well as processing and use of his personal data by the method of disseminating such personal data in order to fulfill obligations under this public agreement Offers by the Contractor or other third parties for him. What is registration?
The registration is basically the process by which the Russian authorities are notified, after your arrival in Russia, of the place where they can find you if needed.
When to register?
If you are staying in Russia less than 7 business days, you don’t need to register (you are not obliged but each accommodation has to register you upon you arrival to the premises). For example, if you arrive in Russia on Saturday, August 1 and leave on a Monday, August 10, then you don’t need to register since your stay will be 6 business days. Weekends (Saturdays and Sundays) or the holidays don’t count as business days.
The documents that justify your arrival and that allow you to make you the count of the 7 business days is immigration card given by border control officers when you cross the border.
Who must do the registration?
Registration must be done by the host:
- Hotel. If you stay in a hotel, then the hotel management is responsible for the registration upon your check-in.
- Apartment. The host of the apartment must make the registration, be it an individual or a company that manages the apartment.
- Private homes. If you are staying in a private home of a friend or relative, then your friend or family must make your registration at their home address.
Registration is always the responsibility of the host, which must be a Russian citizen or a foreign citizen with permanent residence in Russia.
Registration must be made no later than 1 working day from the date of arrival to accomodation.
The foreign citizen can’t register on its own, as it is the responsibility of the Russian host party. In no case is it mandatory for the foreign citizen to be present during registration.
If you stay in a hotel, the administration will register you for free, though it is possible that some hostels or smaller hotels, airbnb will charge you an amount (which can range from 200 to 1,000 rubles). If the host of the accommodation refuses to do the proceeding (even though they have the legal obligation to do it) we recommend to find another option of accommodation which follows the procedure.
It doesn’t matter if in your letter of invitation you included a hotel and finally you stayed in a different one, since any hotel has the obligation to make the registration.
For the registration, the hotel will request at your arrival:
- Your passport, from which they will make a photocopy of pages including the page where your photo and personal data are and the page that has your visa stamped (if required)
- Your immigration card, from which the hotel will make a photocopy.
The hotel administration will also be in charge of the registration process, by filling up the form and presenting it along with the rest of documentation before the Russian immigration authorities. You will be registered in 1-2 business days.
The slip (registration form) hotel can give you as proof and in which the address and the registration deadline is indicated. Once you leave, the hotel will also inform the authorities.
- The registration procedure is the same if you are in Russia through a tourist visa or a business visa, the only difference is that in the case of business visa you can register for a period of up to 3 months.
- If you make the Trans-Siberian route by train and sleep on it, in this case the train ticket would be equivalent to the registration (you always have to keep your ticket in handy).
- Registration slip is not necessary to leave the country, though the immigration card is required.
